The Memorandum of Understanding (MOU) and Supplementary Agreement describe the framework for coordination, information sharing, and interface processes between the DNFSB and the U.S. Department of Energy in support of the Board’s independent nuclear safety oversight mission.

This Memorandum of Understanding establishes the overall framework governing interactions between the Defense Nuclear Facilities Safety Board (DNFSB) and the U.S. Department of Energy (DOE), including access to facilities, personnel, and information necessary for the Board to carry out its statutory oversight responsibilities. It outlines mutual expectations for communication, coordination on directives and regulations, and procedures for responding to Board recommendations and reporting requirements. The MOU also provides for periodic review and updates to ensure the framework remains current.

Supplementary Agreement for Memorandum of Understanding Between the U. S. Department of Energy and the Defense Nuclear Faciliities Safety Board - May 27, 2022

This Supplementary Agreement implements the February 17, 2022, MOU by detailing specific processes and practices for DNFSB–DOE interactions. It addresses topics such as resident inspector access, requests for information and site access, coordination of reviews and site visits, interfaces on directives and regulations, written communications, recommendations and implementation plans, public hearings and briefings, and escalation procedures for resolving interface issues. The Supplementary Agreement is reviewed periodically and may be modified by mutual agreement of the Parties’ career staff.
